Qualifying Period for ILR - Early Arrival vs Entry Clearance

Post by RakeshNZ » Thu Jun 05, 2014 5:23 pm

Hello

Just to confirm what I believe to be the correct answer (which I hate):

Entry Clearance for my Tier 1 was 25/09/2009.

My first day in the UK was actually stamped as 24/09/2009 (Nightmare with flights). Hence 1 day early.

I then didn't "re-enter" the UK until 20/2/2010.

With my Tier 1 extension expiring on the 25/09/2014 - I'm assuming I have to extend out my Tier 1 again before I can apply for ILR come 20/2/2015.

Is my understanding correct? For the sack of a single day - I'm tempted to attempt a Tier 1 and I can't find a clear link on the new UKBA website to send them a query. I believe I was legally in the country and working (paying tax, etc) but I'm not sure how a Visa is deemed "activated".

I've tried a search query on this board but I can't seem to find someone who's had my particular question.

Any help would be kindly appreciated.

Regards

A potentially frustrated Kiwi.
