queried regarding ILR for my partner

Hi all,

I am under Tier 1 migrant visa currently,and i was on a work permit earlier.Im eligible for my Indefinite Leave to Remain[PR] visa in December.
Im planning to get married in August and bring my partner soon after that. I know I have to bring her here as my dependent on the Tier 1 migrant visa I hold.

The query I have got is when I apply for my Indefinite Leave to Remain[PR] visa in December,do I add her as my dependent in the application I make?

or will she have to wait for 2 years till she qualifies for her Indefinite Leave to Remain?

And if I have to apply for her as my dependent in my ILR application, does she require to pass the English Language Test?

I hope I'm making some sense.

She cannot be included with your ILR application as your Tier 1 dependant if she hasn't spent at least two years living with you in the UK.

She will have to switch to FLR(M). ELT is required prior to switching.

so when will she have to switch to FLR(M) visa ? Is it after I get my ILR visa? or does she have to do the switch along with my ILR application?

Probably along with your application. Should be before her leave expires.

Depending on how soon you mean. you can wait till you get ILR and then get her on dependant visa based on your settlement.

My current Tier 1 Migrant visa expires in March 2013.I held a worpermit before that,which was issued to me in Jan 2007. So I believe I am eligible for Indefinite Leave to Remain in Jan 2012.

I plan to bring my wife this September,and I know that my wife will have to apply "Tier 1 general applicant - dependents" in India. And I believe the visa that she gets issued will expire in March 2013,since my Tier1 Migrant visa expires in March 2013. And also she does not require ELT while applying for the visa. Please correct me if I am wrong.

So once I successfully get my Indefinite Leave to Remain,my wife will have to submit the FLR(M). And while she puts in her FLR(M) application I believe she will require the ELT test.Please correct me if I am wrong.

Will the IELTS certificate in India be sufficient when she submits the FLR(M)? or Is it some other test she has to attend? The reason I am asking this is because she will be in UK while submitting the FLR(M).

And how long will the visa issued for if she is successful in applying for FLR(M) ?And just out of curiosity what does FLR(M) stand for?

Sorry Im just so confused after reading lot of stuff.Im just trying to get all the information I need before we start applying.
