Queries ILR July 2011

Post by hillybilly » Thu May 26, 2011 3:49 pm

Hi all.

I am on WP since Aug 2006 and due to apply for ILR July 2011.
Got a couple of queries here.

1. My Entry Clearance validity : Aug 7, 2006 to Aug 7, 2011 as it says on the visa sticker in passport.

What's the exact date that I become eligible for making ILR application after calculating 28 days before completing 5 years residency and considering I entered UK on Aug 9th.
Am I right to assume that I should count my 5 years from Aug 7, 2006 instead of 9th? Asking this as I just stumbled upon this thread : http://www.immigrationboards.com/viewto ... d07b577245

2. My employer is moving to a different address (well, only to another floor in the same building) 3rd-4th week of June. Which is less than a month before I plan to make ILR application. I guess, my employer will require to inform the UKBA authorities of this change through 'Technical Change' form. Is it true that it takes them a while to get this info into their system? And will it make my case not straightforward then, as they might need time to cross check etc?

3. My Employer moved to our current address 3 years ago, and neither I or the employer were aware of the 'technical change' requirement. We found out about this only recently when I started researching towards my ILR. So, the authorities never got informed of that change. How much of an issue would that be while applying for ILR?
I am confused and stressing out about how to deal with that and the new change..

4. I was looking online to book my appointment for the Set(O). Didn't see any available for 2nd and later weeks of July.. Is it true the appointments only become about 6 weeks in advance only?

5. While booking the appointment, being on work permit am I right to choose 'set(O) excluding long residency' application? Or should it be 'Set(O)'

Please help!
Thanks in advance for your inputs.

What's the exact date that I become eligible for making ILR application
The day of entry in UK
2. My employer is moving to a different address
3. My Employer moved to our current address 3 years ago, and neither I or the employer were aware of the 'technical change' requirement.
This is a legal requirement for your WP.Do read the guidance, if you have not done it already. Suggest do it asap, before you apply for ILR. Your employer needs to do the change form and pay the fees. You should then wait for a letter of confirmation, before applying for ILR, as this is a potential problem issue.

Thanks Gidoc

About hoow long does it take to receive a confirmation from the authorities after sending them the technical change form? Will there be enough time to make the ILR application and the online appointment required for that? Should I wait for the confirmation or get the appointment anyway?

Thanks

Though for the WP it is the day the EC was granted as per the modernized guidance and what was discussed here i got my ILR with the gap of 47 days between EC granted and actual travel. Here is the success story.

what gidoc says is correct however this was the same case with me. employer moved address and no one was aware of the application of the technical change. I appeared for PEO with WP on old address and latest letterhead for employer letters with new address and it was all fine. But I am not sure whether this would happen every time so better get the WP amended with latest address

Dont know how much time it will take, it should not take longer than a couple of weeks.
IMHO- you may get away with it but I would not take such a chance, get the letter in hand and then go to the PEO. You can book an appointment anyway, then cancel it and change it if there is a delay, thats easily done.

Thanks for your inputs manyaonisland and gidoc.

I just sent the technical change notification form. Hope it works out to be a right decision. Got my fingers crossed.
I wasn't clear about a few sections on the form and called up the phone number mentioned on the same webpage where you have the links for the form. It was useless. The automated service just tells you to check guidance notes that are on a pdf on the website, which I had done already anyway. So, I gave my best shot with the form and the employer gave me a covering letter to send with the form explaining the changes, just to be sure.

manyaonisland, congratulation for your success and thanks for sharing your thread. Why did you have to present 12 months salary slips though? And bank statements too??
