Query on Dependant Visa

Query on Dependant Visa

My current status in UK is ILR holder. My wife came to UK as a dependant of work permit holder when I was in Work permit. Now she is in india, I got my ILR last year and I didn't apply for her because she was in india. So her current visa is dependant to the work permit holder but my status is changed. Her visa is valid upto Jan 2012.

My daughter is 4 years old, I want to bring her only 6 months along with my wife. They will return to India within 6 months and they will be in india another 2 to 3 years because some personal issue. So I am not planning to apply for the settlement visa and it is very expensive. I don't require at this moment.

My 1st question is, Can my wife come to UK with her current visa (Dependant to work permit holder)? or Do I need to change her visa status since my status was changed?

My 2nd question is, Can I bring my child in a visitor visa and it is very cheap?. She is going to be here only less than 6 months.

Can you please advise if there is any alternative way?

I don't think there is any problem until and unless her visa is valid. But I don't understand your scenario as well. Usually dependent visa expiry is exactly the same as main applicant. And this is also true that you have applied ILR after work permit has been expired. Its mean if your visa is expired then how your wife's visa is valid till 2012. May be I am missing something or not in my knowledge. Tier 1 dependent can apply for ILR with main applicant as well as separately. They can travel alone or with main applicant as well irrespective of main application visa type or status until and unless the dependent visa is not expired.

Yes she can apply for visit visa.

Please don't make multiple posts on the same topic.

IMHO, the WP dependent visa of your spouse is no longer valid as you are no longer a WP migrant.

Both your wife and child may apply for visitor visa to travel to UK if they do not intend to stay there for more than 6 months.

Thanks for your reply and pointed out my multiple posts. Sorry I first posted under Tier 1 General then I realised that it should go under WP section. Finally I thought that it is not only about WP, so then i posted onto the general immigration discussion. Sorry about that.

Thanks for your help, I will go for visit visa for both of them.

I don't think there is any problem until and unless her visa is valid. But I don't understand your scenario as well. Usually dependent visa expiry is exactly the same as main applicant. Thanks for your reply. I had 3 years WP with my first employer then I changed my employer and obtained WP for 5 years which was valid until Jan 2012. That's why my wife's visa is valid till jan 2012. Anyway sushdmehta answered my question and I thought the same.
