Query regarding graduate route visa

Post by Yetvjk » Wed Jan 05, 2022 9:32 am

Hi. I’m on tier 4 visa since September 2019. My studies will be completed in 2022. I’ll be applying for graduate route after that. In case it’s refused, would I be able to switch to a different visa such as another study visa in UK? Will my current tier 4 visa also expire the moment it’s refused? Thank you

Why are you thinking it could be refused? The criteria and requirements for the Graduate route are very clear and straightforward. It would be pretty hard to get a refusal, unless you did something weird like apply without havinga relevant qualification.

Maybe you can clarify what your concerns are exactly.

I think it could be refused based on general grounds because of a fine. If it’s refused will current tier 4 visa expire immediately? Please ignore other question stated earlier.

Which paragraph of the general grounds, and what were the circumstances of the fine?

I received a penalty charge notice for driving in restricted area and a fine. I’m not sure about the paragraph or even law but I’m thinking that it can be either based on good character or a crime.

Oh right. I am not sure why you are worried about a refusal under the general grounds without having looked at what they actually say, and what crimes are triggers for refusals.

The grounds for refusal for reasons of criminality are paragraphs 9.4.1 (mandatory refusal) and 9.4.3 (discretionary refusal). The grounds for refusal due to the applicant's character is paragraphg 9.3.1.

You can also look at the more detailed guidance for caseworkers on when they must (or can) refuse an application due to criminality. It covers Fines in detail from page 20:

https://www.gov.uk/government/publicati ... riminality

None of the above seems to indicate a problem for someone with a penalty and fine for a motoring offence.
