question about EEA4 applicaion form (need help)

question about EEA4 applicaion form (need help)

Hi members,
I'm filling up my EEA4 application form, there is a section/question 8.2 that
"Please complete the table below for yourself to show any time you have spent outside the UK during the 5 years continuous residence. When counting the number of days."

I really don't remember my visits, the dates of departures and returns. I just remember that I never lived out of UK for 6 months is last 5 years. The stapms are also not clear on my passport to see the dates of departures and returns. I don't know what to do with this question. Please guide me.

You can know it from your E-tickets/boarding passes.

Then if you not in hurry to apply EEA4, you can order your SAR file from UKVI which will disclose your immigration history.

I have done mine, I have gone throught my passport deeply. But I can't write my ex-wife's immigration history, as we are divorced now and I'm living on RoR (retained the right of residence). And I have no any connection with her any more. Even I don't know that where she is living now. How could I write her details?

She was living in UK since we were in relation, never lived out of UK for more than 6 months. That's why HomeOffice gave me EEA2 with RoR (retained the right of residence) status after divorce, Because she exercised her treaty rights. After That I had to exercise my treaty rights. Which I'm doing now. Do I still have to give her details. Even 2years after divorce?

You need to give her details (and proof of her treaty rights) if you want to use your time as married as part of the 5 years. Otherwise, you can wait until you have RoR for 5 years and apply based on your activities only).

Put down the details you have. The application will not get refused because you didn't put all the right dates. The HO can check her presence in other means if they wish.

as far as I know, that I don't have to wait to finish my new EEA2 card with 5 years, what I got as RoR after divorce. I just have to finish my 5 years in Total as a EEA national family member. You can see in this web link.

The difference is only this, that now I have to exercise the treaty rights, after Divorce till finishing the 5 years period.
Please make me correct if i'm wrong.

And again, my question is same, that is it ok? if I show only my absence period from UK. While I have already got RoR, and I'm living on my own now, and exercising my own treaty rights after getting RoR. Do I still have to write her details, especially when I do not have.

And my answer is the same.

Retaining your residence rights allows you not to be dependant on your ex activities after the divorce. However, if you want to use time as married for the 5 years, you need to provide proof for that time. See the link you referred to. It has a list of the documents he posted including the ex documents.

Actually , I have to make it clear, that if I do not have the details of my ex-wife's absence out of UK, till our Divorce. Then what I suppose to do? She was exercising her treaty rights till the divorce. That's why I got RoR.

After getting RoR, I'm exercising my treaty rights. And I have details of mine, about everything, including exercise of my treaty rights after divorce plus all details of my absence out of UK in period of 5 years.

I just want to know, that in EEA4 application form, what I should do/write, if I don't have my ex-wife's absence details from UK, till divorce.

If you have evidence of her exercising treaty rights for the whole period leading up to the divorce but just don't know her absences, you should be fine. You can write that you don't have this information but you can conform that she wasn't absent more than the requirement (which is 6 months a year).

It's the treaty rights evidence that is important.
