Question for any experts on immigration

Post by Irisheddy » Wed Nov 03, 2010 8:04 pm

Hi,
An African friend of mine has been living and working illegally here for the past 6 years. For some reason he registered under a false name and is currently on "permission to remain" status.

Apart from this he has been a model citizen. He has no criminal record, pays taxes, social welfare and has not been a burden on the state. I advised him to come clean but he is afraid he will be deported.

Maybe I am innocent but I like to believe that honesty is rewarded. Does anyone have any experience of cases where someone comes clean?

he is not a citizen of this country. I don't wish to sound rude, but it is a crime to work illegally and registering under a false name. Since their is an insistence of a passport to register, one would assume that he/she has a false passport, again, contrary to the law

on what basis was he granted IBC (might be ok provided he gives real id), refugee (screwed, and rightly so)? what is his real nationality?

The Gardaí and Department of Justice is well aware of these situations.

South African - Zimbabwe?
Somali - Kenyan?

If or when he applies for citizenship, how does she/he expect to produce birth certificates/marriage certificates?

Good advice! To make sure he follows it, you may also 'advice' GNIB that your friend is using a false name

Seriosly though, he should be deported. Of course, the outcome depends whether he (or you as his friend) can afford an expensive immigration lawyer.

Whilst any decent law abiding person would have difficulty in disagreeing with you, it would be better to know the facts first and basis of that person's residence. Maybe ok if they are parents of ibc. if refugees they will have problems. It will be revoked. But, there is no guarantee that they will be deported.

I am aware of a number (small) who claimed asylum and later IBC and stated they were South Africans. It later transpired that they were from Zimababwe. A very quick glance of COI would make anyone have sympathy and understanding.....

Look, the department are aware of these later admission of truths, the nationalities above. same with iraq/kuwait etc or albania and kosovo
