Question on ILR application via Tier 2 (Employer Sponsored) route

Post by lbhtran » Tue Aug 18, 2020 5:22 pm

hi, I'm currently making my IRL application following 5 years on Tier 2 (Employer Sponsored) visa route. At first, the application was straigthforward. I have passed the Life in the UK test, filled in all details on the form, checked that I'm not away from the UK for more than 180 days in any 12 months consecutive period, and prepared most of my documents.

However, an issue arose when I asked for a letter from my employer stating my work absences. I had a few occasions where I worked remotely from my home country and a country where I was going on holidays. These days were booked and approved by my manager as working from home days. However, somehow my employer's HR system does not hold a record of working from home and they cannot give me a letter to confirm that I was working during those periods. Therefore, I now have gaps in my absence from the UK that are not showed on my work absences letter.

The remotely working periods were short (i.e. 5 days in my home country, 1 day in a European country and 6 days in my home country in that order). I'm now unsure how that would affect my application and whether the lack of documents from my employer to confirm that I was working during those periods would cause a problem with my application.

I contacted my HR department only to get refered to their lawyer who said that I need to pay £3500 to become their client in order for them to handle my application. I also found another lawyer who offered to handle my application as well as helping me resolve this issue for around £1000.

Given that I have already done the bulk of the work on the ILR application, I wonder if it's necessary to hire a lawyer at this stage? If I submit the application, would the absence gaps be highlight? Do I have to provide some documents to justify these gaps?

This is asked almost every week here. :?
As long as your employer confirms that all absences from work were approved by them, you will be ok. No need to mention what you did. In the ILR form, you simply can say 'holidays' for the reason of your absences. You are overthinking this whole thing
