Question on ILR

Hello Experts -My sister was granted tier1 in feb 2009 valid for 3 years, she first came to uk in jan 2010 (after 1 year) and went back home after a month of stay, in feb.she came back to the uk beginning of May after she found a job and have been living here since.she got her visa extended for another 2 years and would obviously have to go for second extn to meet ILR requirement.my question here is the 180 days rule, will it be applied from the day she first came to uk or when she was granted the visa? Knowing first year of visa wasted, can she claim residence for the period (feb-may 2010- less than 90 days) she went back home after she first arrived in uk? Thanks much.
