Question regarding English language test..

Dear Members ;

I have a confusion regarding residence requirement for my Spouse Citizenship application;

here is the history of her living in U.K.

Arrived in U.K. : 14 Jan 2012 as HSMP dependent

Number of days spent outside U.K. are as follows ;

Sep 2013 till November 2013 : 63 days

July 2014 till Jan 2015 : 181 days

March 2016 : Got her ILR as my dependent

Sep 2016 till July 2017 : 299 days ( Because of family circumstances )

July 2019 till Sep 2019 : 38 days

She has spent overall 581 days over the period of almost 8 years .. and I think rule is not more than 450 days over the last 5 years .

I am not sure when to apply for her Naturalisation coz of her residence requirement and how I should calculate before sending her application to Home Office .

Count backwards from tentative date of naturalisation application. Applicant must be physically present in the country 5 years or 3 years (in case married to a British citizen) prior to the date of application. No more than 90 days in the 12 months prior to date of application.
450 days- 5 years
270 days- 3 years

01.11.19 to 31.10.14 - apply above.

Thanks for the reply. I just need to ask you that if I put the earliest date you mentioned below that is 31-10-2014, she was not present in U.K. in that period of time as I mentioned before;

July 2014 till January 2015 ??? So would that apply in this case..

In that case ur spouse can apply for naturalisation somewhere in January 2020 when she was physically present in UK.
What abt ur self? Are you not a British citizen yet?

Nope I am not a British citizen yet, still on ILR.

One more question, she used ESOL Certificate Speaking and Listening , Entry level 3 (QCF) or B1 at the time of ILR which was accepted, so it would be enough or she does need to do another English test??

B1 is fine. Do take the time to read the nationality guidance and form AN guidance in the mean time.

she used ESOL Certificate Speaking and Listening , Entry level 3 (QCF) or B1 from City and Guilds which was Ofqual registered , at the time of ILR which was accepted and ILR was granted ,

So it would be enough or she does need to do another English test?? We are not sure coz they have updated guidance few times ..

By the way she submitted ILR application on 16 November 2015.

Select the option which allows you to rely on the test provided for ILR. No need for a new test.

Applying for citizenship
You can use a B1 level qualification that’s run out if you’re applying for citizenship and it was accepted when you settled in the UK.

It does not matter if the B1 level test you took is not on the current list of recognised tests. You do not need to take another test.

Check what does it say if you select NO??

Otherwise select yes and proceed.
