I am working for IT Company and first arrived in the UK on 3rd Jan 2007 using Work Permit which was later renewed as Tier 2. I stayed on UK payroll through 31-Dec-2009 and then was transferred back to India for a year relating to my job in the UK. This was the same employer who I worked with but my salary was paid in India during this period and eventually returned to the UK on Jan 2011. I continued to travel to the UK during 2010 and didn't have any gap beyond 60 days as such but I did spend most of my time in India. My employer has given me letter which clearly states that my transfer to India was a business requirement and that I continued to play the same role as I did whilst being in the UK. In fact at the completion of my work in India I was transferred back to the UK on Jan 2011.
I have the following P60s / P45s
a) P60: Jan 07 - Mar 07
b) P60: Apr 07 - Mar 08
c) P60: Apr 08 - Mar 09
d) P45: Apr 09 - Dec 09 - P45 only
e) India Docs: Jan 10 - Dec 10 - Indian salary slips/Bank Statements
f) P60: Jan 11 - Mar 11
g April 11 - Jan 12 - Salary Slips only
In addition; I have bank statements as I maintained my bank accounts since 2007 in the UK; council tax bills; water bills; India bank statements in our joint names.
I would like to know if you see problems with my case and whether before making a payment when I apply in Feb 12; I should clarify this with the case worker (if there is any such opportunity)
Second question:
My spouse left to India during Jul 2009 as we were expecting 2nd child. We stayed together during 2010 in India and also after 2nd child was Born; we traveled to the UK for a month to spend summer holidays here. We also got our Tier 2 visa converted into Tier 1 during this time (Jul 2010).
I know that I am required to provide two years proof for Co-habitation; but the rules aren't clear whether this co-habitation should be in the UK or the place where the main applicant resides. In my case during 2010 I was in India and if my case is accepted then going by the rulebook; there shouldn't be any issue with co-habitation requirement. The reason is that if the main applicant (in this case myself); staying in India and dependents not in India won't be called co-habitation. My spouse and kids joined me in the UK on 28th Feb 2011.
I have gone through a lot of documents and as you case see my case isn't straightforward so I would like expert guidance and see if anybody had similar situation before?
