hi,i have a question, if someone appeal is rejected on 2nd tribunal and they apply a fresh application , they will still be considerd under 3c and have right to work?

I don't think so you will be covered under 3c and such any right to work.
But wait for an expert opinion if i am wrong

3C &D expire themselves the day you receive determination from 1st tribunal and you dnt approach upper tribunal or upper tribunal refuses to accept your appeal or dismisses your appeal if heard.
when you would have exhausted your right to appeal on both stages and remained unsuccessful you will not have a right to work(if it was allowed at the time of application) and considered an over stayer after appeal right exhaustion. an over stayer has no right to work while provision applying within 28 days could reinstate your status(being in UK lawfully) and right to work if application(new) made within 28 days has been successful.

no right to work and protection under 3C and D after appeal.
