Questions regarding self employed, marriage certificate

Hi!
I am EU citizen in the process complete the online citizenship form. This board already helped me to clear some questions. But some of my questions I couldn't find answers. So I post this hoping if anyone could help.

1. My wife had obtained her citizenship at the beginning of this year. In my application when it asked if my spouse is British citizen, I said yes. But our marriage certificate was stated she was not British. I don't know if it requires marry a British when obtain the marriage certificate? Should I give 3 years or 5 years residence evidence? . My marriage certificate is not UK one but it had been legalised in the country we got married. I had done the certified translaion, is it enough? Does it need to legalised here after translation? I do have more than 5 years of residence, but if only require 3 years that would save me some paperwork

2. I am a self- employed. I will give last 3 years or 5 yeas tax return documents. Are there any other evidence to prove my resident? Do I have to give evidence for every month in the past 3 or 5 years? It says bank statements and house bills can not as the prove. I do have letters from hmrc or NHS, council tax bill, but they don't cover every month. Are there any other evidence I could give. I see others also uploading bank statement and house bills. Should I uploading bank statements and bills too? I am a self employed subcontractor, so I have a subcontractor employer , have been work with for past 4 years. we don't have a contract and I am not his employee. If my subcontractor employer can give a letter to prove I work with him, is it useful? Or the tax return documents are enough.

3. Do I need CSI as a self-employed? In the document list says student and self sufficient person need CSI. My self employment status is continues, but sometimes I off work for holiday.

4. One of the question was asking if I have national ID card. I do have Europe national ID card, but it has my very old address from 10 years ago, I didn't change it as I am not using this card anymore and I can't remember where I kept, I do have a copy of my ID card. Is this a problem the UK home address on the national ID card was 10 years ago? Can I just say no to the question?

1. Just the certified translation of your marriage certificate as well as copy of her British passport.
2. Just your tax returns for three years required - no other documents necessary.
3. CSI not required - you were not a student or self-sufficient (holidays don't count}.
4. National ID card not required, just your passport.

Thank you so much for your answer! May I ask another question regarding the form,
there is a question:
Are you either:
An EEA national who has been issued with a permanent residence document
A family member of an EEA national who has been issued with a permanent residence card

I have answered yes, but in the required document lists ask for permanent resident card which I dont have, If I answer no, the next page ask me if I have ILR, it didn't metion settled status at all. Should I answer no to the quesiton? Thanks a lot!

We don't have sight of the exact wording of the screen on the application form, but this is what I understand:
If you have settled status then the answer should be NO, as you don't have a PR document.
Then whether you have ILR answer YES, then you should see a selection with includes Settled Status (same as ILR) - select that one.

Thank you. I think you are right. I should answer no to the question as I don't have a PR document, and answer yes to the following question if I have ILR (but in this question it didn't metion settled statu at all). and there is not any selection or further questions regarding this. In HO documents stated that settled statu is ILR. So I guess it is right to answer yes. after I changed answer, the document lists doesn't include the PR card requirement.

If you ansered yes to the PR document, then there is a selection, to choose if want to use PR documents or ILR and settled statu to apply BC. it metioned the settled statu in this selection, so that's how i get confused. Now I think that because someone could hold the PR document and the settled statu at same time.

It would be for the 5 year residency period to obtain Settled Status. Unemployment is not relevant for CSI.

Thanks for your reply. I am not sure if I understand right, I get my settled status last year in Auguest 2019. Does it mean the required period for CSI is date back 5 years to August 2014?

I thought he CSI requirement is only for last 3 years as I married to British citizen. In my documents requirements lists no CSI requirements. So the case work may ask for CSI even it is not in the document lists?

Sorry I meant the 3 year residency period, in your case..
And if the document list doesn't mention CSI then you are ok, because you were not exercising treaty rights as a student or self-sufficient person.

Hi! Thank you! I have just completed the form last night. You are right! I just got another question. If you know about it, please help me.

Now I try to upload the documents. The check list requires the following as a self employed:
most recent tax year account statement and corresponding HMRC tax return as proof of self-employment
I did research online and on this board, but I am still not really sure what documents they are required here.
What is the tax year account statement? is it the SA302 form on HMRC ? I dont have the SA302 paper form, but I could print out from my hmrc online account. Is it good enough? And it also says corresponding HMRC tax return. How to prove that? Is the SA302 form good enough? Or Do I need my bank statement ? ( I don have business account, my earning payments all go to my personal account.) Or any other documents required to satisfy this? Many thanks!

I think it's just the SA302 form - you can only get it if you have done the self assessment submission so should be sufficient. If UKVI need further information they will contact you - but it's not something you could be refused on. Print it off and load with your documents.

Thank you! In my check lists also ask for:
Proof of living in the UK for 3 years.

Is SA302 form also the evidence can proof of living?
But this check list is separate request. It may mean I need to give more evidence than just the SA302 form?

In the guide says, bank statement and bills not a proof of living . Letter from government body is OK. I only have few letters, not cover every month, I only find 1 NHS letter for 2018,. 2 letter ( hmrc and council tax) for 2019, and 3 letters ( hmrc, council tax)for this year , I also have the latest tenancy agreement. But there is no letters for 2017 only some bills. Is it okay?

You just need to make sure in your list of absences that that day is not listed as absence - you don't have to specifically prove it (I didn't!)

Thank you very much for your answer! I do have 2017 to 2018 tax return and SA302. But no other letters for 2017. Council tax letters only cover from last year. No council tax bill on my name before the last year. If I don't have enough letter evidence to cover every month in last three years, is the SA302 can be also proof of living? Thanks again for your help!

Hi! How are you? I have got another question. I hope if you could help me. I have the settled status, but never hold a permanent resident document. I have uploaded last three years resident evidents to proof of living. But I read following info online. I am not sure if I should give more evidence for the period when I qualify my settled status which is between 2014 to 2019. I obtained my settled status 2019.


“As set out in section 5, we expect that many people will have their residence confirmed by automated checks of HMRC and DWP data. However, where those checks indicate that an applicant who does not hold a permanent residence document has been continuously resident in the UK for a period of less than five years – or do not indicate that the applicant has been and remains continuously resident here – the applicant will be able to upload documentary evidence to satisfy the Home Office caseworker that they are continuously resident here and, where appropriate, that they have been so for five years.1”

I am not sure if understand the above info correctly. Should I give evidence from 2014 up to Now to approve the period qualify my settled status. Ori just need to give last three years from 2017 to now?

For naturalisation (as spouse of British Citizen) the residency requirement is 3 years which you need to document. You are not re-running the Settled Status application, for which you were approved of course (on the basis of five years or more residency as EU citizen). The document relates to Settled Status applications, not to naturalisation.

Hi!
I still waiting HMRC send me the latest SA302, but I worried it won't arrive before my appointment. HMRC told me that I could download the SA302 myself. I couldn't find download option, and I don't think there is one. However, it allowed me print it out, So I think I can scan it. The printed pages clear shows that is online version as there are links at the top of the pages, and printing time and date on the bottom of the pages. Do you know if the online printed version is sufficient? Many Thanks!

I should think so - it shows the document is from HMRC, and they also have their own access to HMRC data if they want to validate.
