WP Questions

Post by goosekool » Fri Sep 24, 2004 5:09 pm

Sir,
I’m a newbie to this. I have a valid work permit for 2 years and currently working in UK as a contractor. My contract is getting over by next month and I would like to try for a job by my own in UK (not with the work permit sponsor company) If I have selected by my own, Will the WP sponsored company cancel my work permit? Do they have rights?.
Please answer to my question and send mails to goosekool@yahoo.com
Thanks
Dhanush

Well the permit actually 'belongs' to the company. i could be wrong ofcourse but if you check in the workpermits notes on the HO website it should guide you to your answer, its hard to say as dont know the full circumstances of your case. but here is something i copied from the notes

What if the person does not take up the post or the employment ends prematurely?

117. It is important that Work Permits (UK) is notified at once if the person does not take up the post or if the employment of a work permit holder ceases prematurely, whether the employee leaves voluntarily or is made redundant. Work Permits (UK) should also be informed if your company ceases to trade while you still have work permit holders in your employ.

Your Work Permit and any corresponding visa or further leave to remain are no longer valid when you stop working for the sponsoring employer be it through resignation, termination etc inclusive of any contractual notice period. Although not explicitly stated in the immigration rules current Home Office operational policy is to require the employer to inform them of your leaving - the carrot here is that it makes it easier for the HO to issue future WP's due to good behaviour/ compliance with the WP scheme.
