I was a Tier 4 visa student and I have been in the UK on Tier 4 visas since Fab 2011 for Bachelor's and Master degrees. I am now married to eu citizen who has not received her settled status under the EU settlement scheme public beta phase As she came in August 2014 and we are waiting till October so We can apply for her settle status it’s because she started work in September and her first pay sleep must have generated in October. I personally think of online Eu exit app it automatically pick up last five year dates from hmrc once you type your NI number in the app during application???? MY MAIN QUESTION IS that if we apply this month what statuses are we expecting to get?? For her I am sure presettle as she has to wait 8 months more but how about me I am in relation with her since 2013 when she was in her country and then she came in August 2014 we were in relation but did not live together as we start living together in May 2015 and got married in October 2015..how would they count my 5 continuos year from???? Fab 2011 when I arrived I used my NI in 2011. Or the date she arrived? Or the date we moved together? Or the date we got married? Or the date I got my RC which was in December 2015..

From the date you got married. Your time before the marriage is not qualifying as you were then NOT yet a family member of your wife.

In your case, condition 3 is met: https://www.gov.uk/guidance/immigration ... -to-remain
3. (a) The applicant is (i) a relevant EU citizen, (ii) a family member of a relevant EU citizen or (iii) a family member who has retained the right of residence by virtue of a relationship with a relevant EU citizen; and
(b) The applicant has completed a continuous qualifying period of five years in any (or any combination) of those categories; and
(c) Since then no supervening event has occurred
