Redundancy during 4-year WP

Currently 3.5 years on WP (not HSMP).

There are some redundancy talks (with notice as short as 1 day while my notice in the contract is 4 weeks).

Q: How much time will I have to find another job before Home Office asks me and my dependants to leave the country?

Technically you are required to either:

1. Leave the UK.

2. Obtain a new WP and WP visa.

3. Change status e.g. to student etc (only possible if you are a non visa national and only in some limited categories)

Within 28 days of the Home Office notifying you in writing to do such pursuant to you no longer working for the sponsoring organisation. The HO will learn of your redundancy through your employer (some don't inform them) or when you apply for new leave to remain. It may take the HO some time..IMHO 2 months or more to write to you. It is best for you to seek a new sponsor immediatley and obtain fresh WP FLR....you have only a short time to apply for ILR and such is in your best interests. Alternatively if you meet the HSMP criteria apply now as decisions are being made within a week and sometimes on the day. You can then apply for HSMP FLR. Note that the application for HSMP (stage 1) does not protect you from overstaying....I pointed this out in the HSMP FAQ last year and so have the Home Office in the workingintheuk site.

First of all, thanks for the reply.

(a) As far as 3 is concerned - I remember it used to take 10 months to get HSMP, so stopped keeping an eye on it. Has something changed?

(b) As far as 1 above is concerned - as long as the new job is in the same HO category, new WP but no new visa(!) is required. This is how I transfered into current position over a year ago, without leaving the country, as advised by WorkPermits. But I had to plan the timing carefully.
