Hi

My situation is a bit complicated i need help about it..

My asylum application is refused but in meantime i got a kid from partner who is pre settled status romanian citizen we had relationship nearly 3 years we are not enemy at this point my kid just born 3 months ago but our relationship is going to be end soon we are not very good with it.

Can make a family application through my kid ?

Any help appreciated at this moment please thanks

It depends what you mean by a family application?
If you mean through the child’s mother and the pre settled status - that would be a no. Your relationship started after the cut off date to be a partner.
As for being the parent of British born child - that is a possibility but it is complicated as the child although born in the U.K. is not yet a British citizen.
If your relationship with your partner is going to come to an end that will make things very complicated.

Did you live with your partner as if you were married for the last two years? Have evidence of joint bank accounts, shared utility bills, joint lease / rental agreements then there is the partner route - but you will need a joint income of £29k.

Given your circumstances I would suggest you take professional legal advice.
