I received a refusal from the Home Office after my leave had expired and was given the right to appeal. After taking advice I opted to submit a second application which was successful. Having read this site I believe I should have appealed.
I am worried that due to the time difference between my first visa ending and extension beginning that the HO will rule that I have had a break in 'continuous residency' for settlement. I have written to them regarding this matter but do not get a response. If anybody here has been in a similar situation I would be interested to know how it works.
03/02/09 - Submission of Tier 1 Extension application (roughly 4 weeks before visa expiry as per HSMP guidance)
07/03/09 - Leave under HSMP expires pending HO decision.
27/03/09 - Refusal letter received, non-corroborating earnings proof. I thought pay slips plus a letter from employer counted as corroborating. Right of appeal granted, deadline 14/04/09
30/03/09 - Submission of fresh application with bank statements corroborating earnings for same period.
14/04/09 - Deadline for appeal of initial decision
20/05/09 - Receipt of approval letter for Tier 1 extension, effective 18/05/09 - Extension application successful, leave granted to 18/05/12
