Refusal Letter Contains Error By ECO ?????

Post by charlotte000 » Fri Aug 12, 2005 2:05 pm

I am new to these boards and I just wondered if anybody had experience of a refusal letter containing an error that has been made by an ECO ? My Fiance supplied documentation appertaining to his employment which included a contract stating his salary. The refusal letter contained his salary in the local currency and then showed the ECO's conversion of this amount into sterling, the calculation was over £1000 out and the excuse that this was a typo could not be used because the ECO then goes on to explain that this is an exceptionally high wage and is also twice the salarly of a government official ?

I am presuming that because of this error the assumption has been made that he has not been genuine, well in fact, that is what is said. We are both mortified and when I think of how many documents we supplied over 200, also how many calls I made to UK Visa's to make sure that what we where doing and supplying was correct it makes me want to weep.

I feel at a loss as to what to do and I have come here to ask for advice or to see if anybody else has experienced anything like this and what happened to them and how they dealt with it ?

Thank you and I would be so grateful for anything that you can tell us ?

Something Else.....

Sorry me again, I forgot to mention as well that they have not stamped his passport to say he has been refused, is that correct ?

Many apologies but it is just that I am so confused right now and feeling very weepy about this whole situation and as I said before any information or advice that you can give me would be so very gratefully appreciated.

Hi Charlotte, sorry to hear about your Fiance's refusal and i'm afraid i can't help really. Just wanted to say my Husband was refused a visa last week and his passport was also not stamped, the ECO didn't even sign or date his refusal letter!!

Do you have the right to appeal? Was the appeal form given along with his refusal letter? Because my Husband said that it may not have been stamped if you have the right to appeal... just guessing really.

I think if you appeal, you can explain why this is a mistake and show the evidence for it, then they may review the case and decide there is no need to appeal, but i am also new to this, so i'm not 100% sure.
Claire.

Hello Claire, thank you for responding to me and I am sorry to hear about your Husband's refusal.

Yes, we do have the right to appeal and I have been getting some advice from an immigration solicitor at my local law centre to see how we need to proceed.

We have both already written to the ECM and the HC at the mission where this occurred as that is what we where adviced to do, still waiting to hear what is happening on that front. I am really getting angry about it now, feel like I am bashing my head up against a very brick wall.....

Thank you again and I hope everything goes well with you
