PR Refusal

Post by helix1 » Fri Mar 07, 2014 2:43 am

my story, i had married with my wife in 2006 in Uk, and got my RC in 2007 as 5 years , my 5 yrs residence experied in 2012 july an submitted in july 2012 my pr application after long long wait got my Refusal Letter....

Reason for Refusal Letter :
in order to qualify for permanet residence you must satify the regulations. Regulation 15(1)(b) states..

in section 6 the EEA4 aplication form you state that your EEA national spouse has been employed, from 2004-2012. as evidence of this employment you have submitted an p60 for April 2010, two wage slips one of which was unopened and a photocopy of a p45. this department is unable to accept photocopies of documents and therefore the p45 you provided can not be used as evidence. you have therefore failed to provide evidence of your EEA national employmet from november 2007- april 2009 and 2010 to date..

th problem is these years my wife had worked but we did not keep her payslips and now we struggle to find any of them so we have tried to HM Revenue tax history of my wife and they send her tax payment from 2004 to 2013 which all paid..

i have an appeal now and will be next month a couple weeks left ...that tax history can be enough for evidence

please help give me an ideas.. thank you

Is there a way that she can ask her old employer for copies of pay slips. I know that they don't accept photocopies but it would be better than nothing. Also, try to get letters from the employers stating that she was working there. Is it possible to ask them for a standard reference letter quoting the dates she worked there and the approximate number of hours she worked?

Hope this works out for you!

I think this is a lesson in document storage :)

I think you will be fine with the tax history, but i will still advice u to move this topic to appeal time line.
