Regading P60s for ILR

Hi All
I came to UK on Jan 3rd 2006 and worked till May 6th 2007 and went to india to serve my notice period as I got employment offer from UK employer. I came back on 1st of July 2007 to join my current employer. While coming back in july 2007 I travelled using the WP issued by old employer and then got the WP changed while i was in UK as I had 6 month time to change the WP.

Query: Will the gap of 2 months May and June 2007 will be counted for ILR 5year calculation or will they treat as out of employment?
more details:
Jan 2006 - May 2007 employer 1
July 2007 - till date employer 2
Had valid work permits in the gap of period so will they treat as holiday or a gap.


Query 2:
i have all P60's except 1yr P60. I requested my preivous employer to issue and they said they will issue statement of Earnings and they said it is equivalent to P60, is that correct?

Please let me know as my current WP is expiring on Jan 3rd 2011, i thought i will apply ILR 28 days before so no need to ask my employer for extension. If according to Query 1 if they consider 2 months as gap then i need to ask my employer for extension.

what was your contractual end date with employer 1 (e.g. till what time did you receive your salary). You say it was May 2007 and then u went to india.

If it was May 2007 then you might be in trouble as your work permit was not valid when entering UK in July 2007.

my WP was valid for 2 years (issued on Jan 2006 valid for 24 months Jan 2008) so i entered into UK on old WP only. the employer 1 did not cancel the WP.
