Regarding my baby's visa

This is a query regarding my new born baby's dependant visa. Could you please help on this.

The situation, I got my ILR on July 2013. My wife came to UK in July 2012 and she is still on category Tier 1 General dependant visa (applied after 9th July 2012). Currently my wife is in India for delivery and our new born baby is 2 months old now.

I am planning to bring my new born baby on dependant visa to UK. I have gone through the forums related to this category and also the UKBA URL "http://www.ukba.homeoffice.gov.uk/visas ... /children/".
What I understand from these details, I need to apply for my new born baby as PBS dependant visa (In this case it is Tier 1 dependant).
I thought of doing the visa processing in India through an agent and the agent says that for my baby I can apply only as ILR and cannot apply as Tier 1 dependant.

1. Could someone who come across this situation can confirm whether I need to apply for my new born baby's visa as PBS dependant or ILR directly
2. Is there any problem for my wife to return to UK as PBS dependant visa (Visa expires in June 2014) as I am currently on ILR.


Kindly advice.
