Regarding Settlement or PR - Come here-work and go back

Hi,

This is my fourth year in UK (yet to complete) and i am completing 5 years by october 2012. I saw an article in timesofindia.com whose link is given below:

Does this mean, that people like me who complete 5 years with HSMP or tier1 cannot apply for PR or settlement by the end of 5 years?
