registering Islamic marriage

registering Islamic marriage

My partners eea4 application has been refused as they are not recognising his Islamic marriage. I understand mosques do not always have the legal status churches have. However, he was told by registering it would become legally recognised. So, the marriage was registered in both parties countries, and london. Is this grounds for appeal?

A sharia marriage in the UK is not legal.

I didn't get it. You mean marriage was legally registered with the marriage bureau, court or registry office ?
For example if the marriage ceremony is recognised as a valid form of marriage by the law of the place of celebration then UK will accept it

Recording a sharia marriage which was conducted in the UK will not be viewed as a legal marriage.

Wasn't registered in Registry office. BUt was taken to court to have it registered, and in Egypt Court and Poland Court.
Is this not enough?

That you've mentioned this as an 'Islamic marriage' has confused this issue a bit. The fact is, the religion of the people who participate in the marriage ceremony is irrelevant. If the marriage is conducted by a Justice of the Peace or licensed Ordained Minister (or the local equivalent as recognized by law), and registered per the legal requirements for that particular country, then the UK will recognize the marriage. So lets forget any of the religious stuff. Basic questions:

Was the marriage performed by a recognized Justice of the Peace or government licensed Ordained Minister and legally registered as per the laws of the country that the marriage took place in? If yes, do you have the original government issued documents to verify this?

If the answer to the first question is no, then the UK will not recognize the marriage. If the answer to the second question is no, then contact the jurisdiction where the marriage was performed to get those government-issued registration documents, attempt an appeal and see if you can submit the 'new evidence'.

Just a point of clarification, both the countries you mentioned, Egypt and Poland, require that Ministers of Religion (Iman for Islam in Egypt) be licensed with the government as such.
