Registration for child born outside the country to British father

Post by rizr73 » Mon Jan 14, 2019 9:04 am

Hello,

I was working in the UK under a work permit from 2001, and my son was born in 2003 in India. My wife is an Indian national

I got my ILR in 2005 and was naturalised as a citizen in 2006 in the UK. I hold a British passport now.

I have since moved out of the UK (in 2008, currently in Dubai) and have settled here for good now.

I have a daughter born in 2009 in India who holds an Indian passport and another son born in 2014 in Dubai, whom I had successfully registered as a British citizen, and applied for and obtained a British passport within a few months of his birth.

I have two questions:

1. My daughter was born in 2009 which was after my Naturalisation, my understanding is that she will be eligible to be registered as a British citizen. Is this correct, and what is the procedure now for registering and applying for a British passport?

2. As my son was born in 2003, what are his chances to be registered as a British citizen? In the event that my daughter is eligible, then there would be 3 members of my family (except for my wife and son) who would be British nationals. Would the Home Office consider my son's case under these circumstances?

Pleased if anyone can advise

Kind Regards
Rizwan

Children born AFTER you became British are AUTOMATICALLY British by Descent and apply for a passport directly.

Child born BEFORE you became British cannot be registered and if you wish to return to the UK, will follow the same visa path as your spouse and ILR etc.
