Renewing Visa by leaving/entering the country

Hi everyone,

I'm in a process of appeal for the Resident card application of my non-EEA wife. I heard that if we leave the country and then go back, she will be automatically granted the same 6-month spouse Visa that she initially was granted when we arrived two years ago.

Is that true ? If so, how can we be 100% that we won't have problems at the frontier when we go back ?

Yes it's true. EEA dependants can't be refused for lack of a visa.

But is it not somewhat nonsensical ? I mean, we could do that during 30 years and she would never have to definitively leave the country .. o_O

Except that you'd probably have to keep explaining yourselves to the IO at the UK point of entry border! Worth the hassle?

Well, if the law gives us the right to enter whatever the reason, I don't see where the problem lie. They cannot say for example : "Sorry, the object of your coming does not make sense to us", can they ?

But I still cannot believe that, if my wife fails the Visa application appeal and is deported by British authorities, she can actually come back the very same day and be granted a brand new Visa.

I mean it can be complicated to get someone actually deported. That the person is allowed to immediately come back once it's finally done sounds unreal to me.
