Request for Information - STAMP 1G TO STAMP 1 - My Immigration refusal in UK

Hello Guys ,

My wife's visa status in Ireland : Kindly advise me on this.

After Post Graduation from University in Limerick my wife applied for stamp 1G and she has been granted stamp 1G on November 17th. Here are my My few questions.

1) Can my wife sponsor me a dependent visa on stamp 1G ?

2) Is it true that after one year of stamp 1G my wife can change to stamp 1 with out any job offer or sponsor ? Currently she is working as a part time worker for an education consultancy (10 Hours weekly).

3) As a husband when can i expect to join her as a dependent under what visa category ? and how long does it take dependent visa of a critical skills work permit holder to process if she acquires one ? since I'm based in India at the moment.

4)My Immigration history has one major refusal based in UK for permanent residency back in 2017. I was accused of marriage of convenience by the home office after living with my EX partner for almost 5 years in UK .When i was in UK i appealed against home office that the decision was incorrect and baseless . In that mean time of appeal process my Ex and i filed for divorce and got divorced before the date of hearing approached . After one month my father passed away since i'm the only son Due to my mother's deteriorating health and doctor's letter i had to withdraw the appeal and nominated myself for volunteer departure on my own ticket expenses and boarded back to India.

How will this impact on my dependent visa or visit visa for Ireland ? and what measures should i take going forward ? Is their a possibility for me to get a dependent visa when my wife is eligible for one.

i will Appreciate your genuine advise and guidance on this matter.

3. If she has a CSEP, you can apply for family reunification immediately. It takes about 3-4 weeks currently to process such visas from India.
4. Frankly speaking, it’s very unlikely since the UK and Ireland share the same immigration data.

Does that mean i should forget about my wife and should not proceed with Dependent visa once she becomes eligible for CSWP?

I mean, there is no harm trying. You certainly have a LOT of explaining to do in your application.

Just to confirm i have a 2 year old son which am raising alone at the moment with out her mother . Will this be considered for family unification ?

OP, you have a very complicated case. By divorcing your previous wife and leaving UK voluntarily you basically admitted that you and your previous wife have committed an immigration fraud in the UK.

It's very serious. You might have a criminal record or an ongoing investigation against you.

Better speak with a good solicitor.

To confirm only i was accused of marriage of convenience not my ex wife as per home office . My EX wife plotted complaints against me after living with me for 5 years together .

How to know if i have a criminal record in UK ?

Contact police and immigration office in the UK.

If there's anything on the system against you in the UK, it will be easily accessible to Irish immigration service. This will have serious impact on your future visa applications.

I don't believe you have a criminal record in the UK. However, you have an awful immigration record with an accepted accusation of marriage of convenience. As you didn't challenge it, it means it stands.

UK and Ireland share immigration information. So Irish authorities will know that in the UK you tried to use an elaborate ploy involving a marriage for 5 years in order to obtain immigration paperwork. Your current application would look as you trying with another marriage in another country.

They won't take decision automatically just because what happened in the UK. They need to do their own investigations but you start with an undermined credibility.
