My husband (Indian national, stayed in the UK for last 6 years on tier 1 general visa) intends to apply for his Residence card as my spouse (Polish national, permanently settled in the UK). His tier 1 visa expired in october 2015, however, we married after a long-term relationship (3 years) in august 2015 (before his tier 1 visa expired).
My questions are :
a) is he in breach of immigration rules after his tier 1 visa expried in october 2015 (even though we married prior to that and had been partners for 3 years)?
b) is it necessary for him to apply for a residence card at all to continue to stay in the UK?
c) would it be better / quicker / simpler for him to apply for an EEA family permit rather than a residence card by travelling to India just for the application ?
any advice appreciated. Thanks!
