Retained Rights of Residence or Permanent residence.

Post by disturbed » Thu Apr 17, 2014 12:24 am

Hello All,

I am sorry if something of this nature has been treated initially, I just cannot seem to find it anywhere.

I came to the UK Oct 2008 and got married to an EU citizen in December 2009. RC was granted March 2010.

We are divorced now and I am wondering what to do next.

Divorce started in December 2013 and is finalized now.

It will be 5 years of marriage in Dec 2015, or 5 years of RC being issued in March 2015 but I am over 5 years of legally resident status in the UK.

My question is that-

Do I apply for Retained Rights of Residence or Permanent Residence (since I have been here for over 5 years) or can I wait to apply for Permanent Residence (and when can I do this?).

Please advice as I am very confused as to what I should.

I do really appreciate all the support you have been offering.

Thanks all.

Miracle need

Thanks Miracle need.
Any reason behind your suggestion? I just want to be spot on in my decision making.
My divorce took about 4 months (December 2013 to April 2014).

House, please I need your input.

Cheers.

No. The reason for divorce is not stated in the Decree Absolute.
