Retention of right EU4Fam info needed

Hi Guys
I have 3 years marriage no children
EU spouse is trying to leave without divorce or annulment ..we were resident with sufficient fund and updated Eu treaty rights about it last year
I am wondering if i have a possibility to stay ?
I have in Ireland for 2,5 years Eu4Fam always worked and now earning 38k€ / year

So your wife is now going back to eastern europe? In order to qualify for retention of rights after she leaves the State, you would have to be divorced or taking care of children in the State. As you hvae no children and your wife does not want to get divorced, this leaves you in limbo. However, if she does leave the State, i would apply for retention on form EU5 anyway and state that you were married for 3 years (which you will be in a few months) and both of you resided in the State together for at least one year.
