returning on spouse visa when under 21

Post by confusion » Fri Jan 01, 2010 2:14 pm

Hi all

I'm English and I got married 3 months ago in an islamic contract. My husband is a Palestinian from Lebanon and has overstayed his student visa since Nov 2008. We both want to return to Lebanon to see his family e.t.c but ofcourse he won't be able to return to the UK and I want to finish my 3year degree when I return.
As far as I know we have to be 21 to apply for a spouse visa, however I'm 19 and my husband is 20. Also I do not work full time or at all at the moment.
I do not wish to return to the UK without my husband, but I also do not want to be forced to move to Lebanon without my degree!
What should we do in this situation, what is the safest thing for us do?

There is no nice solution for you.
The best thing to do is for your husband to return to Palestine until you are both 21 and re-enter UK.
You finish your course and find a job and get everything ready for your husbands return to the UK.
There is no way around the age rule

Many "islamic contracts" are not recognised in UK law if you did this in the UK, so he may not be husband.

Hopefully the mosque or wherever you did this explained the situation to you.

There is no chance for him to come back even if the marriage is recognised until you are both 21. He has blown his chances to return as a student by breaking the law by overstaying his visa.

You could move to another EU country, or Lebanon as you suggested.

I'm sorry about your situation but a lot of people are in the same predicament. Waiting it out like the others have said sounds to be the best option.
I tell it like it is.
