Returning to the US after a 3 months stay there

Post by Julien Grants » Mon Jul 06, 2009 3:00 pm

Hi,

I'm French and I've just come back from the US where I stayed for 3 months (april/may/june) with the visa waiver and I would like to go back there soon (in september ideally), either for 3 other months or with a B1/B2 visa up to 6 months. The thing is I want to try out for a professional indoor soccer team in October. Let's say they take me, I would then logically need a different visa since the B1/B2 doesn't allow me to work. Is the change of visa possible in the 3 or 6 months when I'm there or would I have to come back to France to wait for a possible new visa ?
And also, is there a reasonable amount of time before returning to the US after my first 3 months stay ?
Thanks in advance.

J

How long can I stay in the US during a one year period while being on a VWP or a B1/B2 ? If there's a rule, is the year counted from january to december or from my first day on the US soil ?

The usual advice is to spend as much time outside the US as you spend inside, but admission is up to the POE officer and may be denied if they suspect you are living in the US.

About your earlier question, you would need your employer to sponsor you for a visa.

Personally, I was in the US this year from March 31 to June 30 and it was my first time ever. Is it safe to ask for a B1/B2 visa to go back there for 6 months at the end of september/beginning of october ?

It's very difficult to get a B1/B2 visa if you're eligible for the VWP, unless you can show a good reason and have strong ties to your country of residence. Wanting to spend 6 months in the US isn't really a good reason, and if you can stay abroad that long you probably don't have strong ties... If your visa application gets denied you will be in a worse position than before, since you may have problems using the VWP.
