Review Case.. Please Help

Dear all,

I have to lodge a review appeal against the decision. Please can any one tell me that should I have to submit all docs that I have received back again along with the appeal?

No, you don't have to.

Just write a letter specifiying your Reference no and grounds on which you have requested the appeal. You can not add any new documents but if you did not get the earnings point, you can prepare a table showing the calculations etc....

I thought you could give more evidence for points claimed but not new documents to include the period after the application has been made.

Nopes.

When I spoke to them, they very categorically told me that I can not add any new documents even if they are to support my existing points claimed. The only thing one can do is to better explain the documents. So if you have sent salary slips with IT Returns, you can use an excel file to better explain the figures but nothing more than that.

I can fax the letter to them instead of posting it. I have only 8 days left out of the 28 days appeal period.
Can I submit an organization chart with this letter in support of my claim of senior level experience.(May be I can't do it as it may be considered as an additional document). Please advise me..

JK,

You can always fax it, but I still suggest a courier. As regards 28 days, don't worry. When my application was rejected the first time, I had called them up in UK and told them that I have lost too many days if I decide to appeal. They told me they accept it even if 28 days have passed by. They are fully aware of the fact that postal services delays.

Just go ahead and courier it and fax it at the same time too.

one understands your desperation and frustration, but it could really be helpful to yourself and to others if you explained in more detail about your case. I think there might be some people here on the forum who might have been in the same situation as yourself and they might be able to shed light on how they went about it.

Here are my case's details,

May Applicant
Points Claimed: 70
Age(Under 28) : 5
Education: 15 (Bachelor degree)
Experience: 50 (4 year including One year senior level)

Points Awarded: 55
Age(Under 28) : 5
Education: 15 (Bachelor degree)
Experience: 35 (4 year)

They are not satisfied with my senior level experience.
My question is that can I send additional document like company heirarchy to support my senior level claim?? and what other things I can do in order to support my claim.

To support a senior role claim, you would need the heirarchy chart and in the detailed job description, state how many employees you were/are in charge of.

It's too bad that they didn't just ask you for additional evidence instead of rejecting the case. Maybe you can contact your caseworker by phone or email and ask if you can send additional documents, because it is only 1 section that it is in question. He or she may advise you to just reapply.

JK,

You could go through the "Paid-Appeal" approach that Noddy took. He reapplied his HSMP application and it was processed immediatly. Once you reapply you will have to pay £150 again but will be able to provide fresh documentation. Look for posts by Noddy for more details.
