RLMT for Hiring a Tier 4 student required ?

Hi !

Would a company have to do a Resident Labour Market Test to sponsor a UK Graduate on a Tier 2 Visa ?
(Student currently on a Tier 4 Visa )

You do not have to conduct a resident labour market test if a migrant you want to sponsor is
applying for Tier 2 (General) leave in the UK and has, or was last granted leave to enter, or to stay
in the UK under one of the following:
a)Tier 1 (Post-study work)
b)Tier 1 (Graduate Entrepreneur)
c)the International Graduates Scheme
d)the Fresh Talent Working in Scotland Scheme
e)the Science and Engineering Graduates Scheme.

or where
f)they have, or were last granted permission to stay in the UK as a Tier 4 migrant or as a
student and during their last grant of leave, or a continuous period of leave that includes their
last grant of leave, they have received final results confirming they:
▪have passed and will be (or have been) awarded a UK recognised bachelor’s or master’s
degree, or
▪have passed and will be (or have been) awarded a UK Postgraduate Certificate in
Education, or
▪have passed and will be (or have been) awarded a Professional Graduate Diploma of
Education, or
▪have finished a minimum of 12 months study in the UK towards a UK PhD.


You will have to provide evidence that the degree has been awarded.

N.B. It doesn't have to be the degree for which their current tier 4 leave was granted, so long as the Tier 4 leave is continuous (i.e. not broken in between visas).

Alternatively, if no degree has been awarded then the RLMT will be required unless it is for a job on the shortage occupation list or is for a job paying £153,500 p.a. or more.

Thanks for your reply ECOTROT.

I have a a UK Masters Degree (graduated in Mar 2014) on my previous Tier 4 visa. Subsequently I switched to another tier 4 visa to do an advanced diploma at a college.

So a company need not conduct an RLMT to hire me !

hi Gurus
Need your advice about switching from tier 4 to tier 2 general

my previous immigration history and qualifications are as follows

Ms Marketing Mgmt (Glasgow Caledonian uni) 2009
Psw 2009 t0 2011
then i went back to Pakistan
back again in 2013 for masters in supply chain mgmt
so far i have completed my PgC and currently working on thesis
my current leave is due to expire on an 15 2015

I am currently working with an A-rated sponsor company 20 hours a week for almost a year
now they are willing to sponsor me for the job of public relation manger
do my employer need to carry RLMT ?
and the job should be related to my previous degree i.e. Msc Marketing Managment?
do i need to apply as a new entrant or experienced entrant ?
and any ccj will effect my application?
