RoR - exercising treaty rights from when?

RoR - exercising treaty rights from when?

hi all and i have been reading through almost every post about ror.
One confusion i have when divorced and applying for ror do we we only provide proof of eea national exercising treaty rights from the day divorce proceedings started or for the three years marriage lasted.? I hope its clear what i am asking for. Many thanks

In my case marriage has lasted three years
Lived together for more than 1 year but since early 2014 no habitation
Do not think eea exercises treaty rights during the period as she would not tell me the whole story
I am hoping when we go for divorce i would only need to prove her treaty exercise from day of divorce proceedings in order to obtain ror and not from oct 2012 when we got married

The document of your Ex treaty right required are the one from start of divorce till decree absolute. People to be on the safe sometimes send few proof of treaty right before the start of the divorce.

Fatimah,

I disagree with that. To actually apply for ROR you need the teary right for the last three years up till the time decree absolute is issued if you both married in UK and you both live here.

However, if you married/lives in abroad and later decided to come to Uk and get divorce then you only need to prove just one year which is the third year of your marriage up till decree is issued.

Sorry i never knew that people married in the UK and those married abroad had different requirements for ROR. Never heard of it. What i know is that for ROr the applicant need to show that the ex was a qualified person prior initiation of divorce till decree absolute. Never read on this forum or anywhere in the guideline that they need to prove whole years spent together as married couple just because they where married in the Uk. But if Op is applying for PR following divorce and on the basis of ROR then yes they need to sent whole years EEA nationals treaty rights and one year after divorce non EEA nationals treaty rights.

Will be happy if you could post a link with such requirements for my own knowledge and i am sure it would be helpful for others to.
