SS Route - what next

Post by nclsmiley » Tue Mar 31, 2015 5:32 pm

Hi

Is anyone able to give me some information please. I have recently returned to the UK and is going through the SS Route. I would like to know whether I need to be employed before I can apply for my husband Residence card? Thanks in advance.

If you're British and have returned from exercising Treaty rights, then no you do not need to be employed in the UK for your non-EU spouse to apply for a residence card.

You are covered by Case Law EIND in this regard - as Rosebead says you have no need to work - your residence in the UK is all about your activity in your EU Host State
