SALARY REQUIREMENT FOR TIER 2 EXTENSION

Hi All,

Please I would appreciate some advise from you. My current Tier 2 visa valid from Feb 2013 to Feb 2016, I need to apply for an extension but I realised that the immigration rules have changed (as usual).

While reading the guidelines, (https://www.gov.uk/government/uploads/s ... 1_2015.pdf) paragraph 75,76 & 77 explained the skill level requirement to be qualified for the extension.

My last Cos was issued after June 2012, so only Para 77 is applicable to me which means my job must be on the shortage occupational list NQF level 6. When I checked the NQF document my SOC code was 2129 and the salary requirement is now £32,000. I am currently on £30,000.



My question are;

1. Do I need to meet the new salary requirement on NQF level 6?
2. My application is an extension and not a fresh application, my understanding was that the my current salary must only be equal or more than the previous salary. Most importantly above £20,800. Am I wrong?

3. Can someone please explain para 78, is it telling me that I do not need to meet the salary requirement.

you need to be paid at experienced rate, which for your soc code is 32k.
2 Yes
3. No.

You will need a fresh cos and application form to apply for your extension.

Short answer is, since you have always been in soc code which is at nvq level 6, and your soc code classification have not changed in the last revision of doc of UKVI, the para 78 doesnt apply to u.

Okay Thanks.

It basically means I've got a problem to extend my visa as I do not think my employer is ready to increase my wages for now.

Please what other options do I have;

I heard people taking about pro-rata salary calculation?

how many hours is NQF level 6 calculation based on?

Can I have discretionary application to the home office and explain why I didnt meet the salary requirement?

Or any other option will be appreciated please.
