Savings query

I'm writing this on behalf of my brother. Who has been told by his solicitor that 62000 savings would count towards his wife's ILR due to a "technicality". I sort advice from a second solicitor who told me it wouldn't as the requirement is 62500. I'm really worried for my sister in law please can anyone give me a third opinion.

They have one British child who isn't part of the application.

He doesn't work but is looking actively. He has 5 months to go til application is due

Actually for ILR, the savings requirement is £34,600 for her as she is already on the spouse route.

What technicality? The requirement is that the cash saving must be above (min salary threshold + £16000) for ILR, so £18600 + £16000 = £34,600 minimum
