Savings query

I'm writing this on behalf of my brother. Who has been told by his solicitor that 62000 savings would count towards his wife's ILR due to a "technicality" Did he sought what the technicality actually is so we may learn. I sort advice from a second solicitor who told me it wouldn't as the requirement is 62500. I'm really worried for my sister in law please can anyone give me a third opinion.
Were the solicitors told it's ILR application?
They have one British child who isn't part of the application.

He doesn't work but is looking actively. He has 5 months to go til application is due
