Scenario - Defacto Visa - ILR

Post by Phil_C » Wed Dec 17, 2008 3:33 pm

Hi All,

Does anyone know how the following works in relation to ILR.

My fiancé was granted a Defacto Visa in March this year (we’ve lived together for over 2 years). In March 2010 she will be eligible to apply for ILR.

In the interim we are planning on getting married i.e. in July 2009, however once married, presumably she will need to apply for a spousal visa - does this then re-set the visa process in that she has to wait 2 years from the date the spouse visa is granted before she can apply for ILR i.e she will only be eligible for ILR in July 2011 instead of March 2010.

Any insight or answers to the above will be gladly received.

Cheers,
Phil
