Schengen for Brother of family-member

Dear Forum,

we´re trying to obtain a Schengen-visa for a visit (one week) for the brother of my wife.
  • We are both Belgian living in Switzerland, he´s Lebanese living in Lebanon.
  • Let´s assume for a second that he >>does NOT count as a family member<<, so we´d just like to obtain a "normal" Schengen visa.
  • He planned to come to Switzerland from June 11th through June 18th.
  • I advised him to get an appointment with the Swiss embassy as early as possible, thus 3 months before the trip. (I think that´s the maximum you can apply in advance?)
  • He thus called on March 05th, hoping to get an appointment on March 11th.
    • Answer from the embassy "it´s far too early, call back in a month or so". Nothing really specific, just blabla...
  • Next call April 05th
    • They tried to put him off again, but with lots of persuasion
    • he managed to get an appointment for May 18th
    • which is more than one month later, and only 3 weeks before the planned trip.
    • Add 2 weeks for handling, so his visa would be (dis)approved ~10 days before (hopefully) flying!
  • What happens now is exactly what we feared: The price for his planeticket is skyrocketing, furthermore we can´t book trips and hotels in advance...
  • Next call to embassy on April 13th
    • outlining above timeline and asking to bring the appointment forward
    • reply: "It´s high-season anyway, your tickets won´t change much from now" (Who the F$*% is the Embassy to say something like THAT???)
Had the embassy given us the appointment, as originally planned, on or shortly after March 11th, the whole matter would already be finalised. However, through their absurd stalling tactics, we are now unsure if this trip can happen at all.

Does anyone have any suggestions as to how to deal with this?

I think the Embassy clearly doesn´t know what they´re doing, or are deliberately stalling this application.

What about calling the swiss foreign ministry and chatting with somebody there about what to do.

Did the embassy say why they wanted to put it off?

No idea why - but I learnt new details:

1st call: A guy picked up, unfriendly and unhelpful, not interested to help.

2nd call: A lady picked up, helpful but saying "an earlier appointment is not available".

3rd call: Same unhelpful guy, saying that "ticketprices won´t change much now, so it doesn´t matter and, "no", the appointment can´t be moved".

I was sort-a-thinking about that, unfortunately I have no proof for any of the claims (just phonecalls), as such I have no idea how much that could help?

Most important question: Is my 3-months-before assumption correct? Where can I find the corresponding rules?

Regulation (EC) No 810/2009 of the European Parliament and of the Council of 13 July 2009 establishing a Community Code on Visas wrote:CHAPTER II
Application
Article 9
Practical modalities for lodging an application

1. Applications shall be lodged no more than three months
before the start of the intended visit.
Holders of a multiple-entry
visa may lodge the application before the expiry of the visa
valid for a period of at least six months.

2. Applicants may be required to obtain an appointment for
the lodging of an application. The appointment shall, as a rule,
take place within a period of two weeks from the date when the
appointment was requested.
