Scottish Independence: Meaning

Post by bluecole2 » Wed Feb 05, 2014 10:46 pm

Just thinking if anyone has actually thought of what consequences may arise for both EEA and Non EEA family member seeking PR should Scotland vote yes for independence. Considering that Scotland may have to apply to rejoin the EU as an independent country.

The scenario are as follows:

EEA or Non EEA- Lived in England then relocated to Scotland or vice versa

EEA or Non EEA- Lived through out in Scotland but would prefer to have the UK residence (not Scotland)- Will one have to relocated to UK (not Scotland)?
How would PR work out both?
Will one have to relocate to preferred country of residence?
etc

Thanks for you contribution

This is a guess. The time spend in Scotland during the period when Scotland was part of the UK will count as residence in both the new Scotland and the new UK. At that stage if a person preferred citzenship of the UK/EU then they would need to leave Scotland and move to UK, so as to continue to live in the UK. IF you think about it, the person currently in Scotland is in the UK. That continues until Scotland leaves the UK.

That has tended to be the position in the past, and I see no reason why this should be different. For example, people living in Ireland at the time of Irish independence from UK could elect to remain UK citizens, if they wished to do so.

@Brigid from Ireland- Thanks, your comment makes sense. This is how it should be but you never know these days. Thank you!

@askmeplz82- Thanks, it will surely be great for my health if I don't have to worry about things like this, however this is the time to plan ahead I think. We all know how leaving things like this to the last minute has negatively affected many, that is one thing I have learnt being a member of this forum. So I have got to arm myself with as many information as possible.

I though I should bring up this matter again.

Should Scotland vote in favour of independence, they will officially become independent on 24 March 2016 according to the 'white paper'.

I hope and pray we're all are alive and well beyond this date by which I would have qualified for pr just a couple of days before the mentioned independence day.

How likely is it that I will get a pr card knowing how slow and inefficient ho operates?

I suppose most will agree that ho will not send a pr to another country- ind.Scot. In other words I will have to be within the newly define uk to be sent a pr. Am I right to think this way?

If you applied for PR before the 24th, then your PR will be received as normal, HO will still send your PR to an address in an independent Scotland, if after the 24th, you will be able to claim PR in whichever of the country you choose to reside.

I do not think Scotland will vote for indepence.
