Re: General discussion on CSI and Settled Status. Big issues for people on the EEA-Applications Routes

EEA citizens do not require visa that is for non EEA No. The above also includes EU/EEA citizens! The fact that EEA citizens do not need a visa as a result of EU Freedom of Movement, along with other privileges they enjoy, does not mean they are not subject to immigration rules! These rules as well...

Re: General discussion on CSI and Settled Status. Big issues for people on the EEA-Applications Routes

you need to have CSI if you are not financially active This is obvious to everyone as CSI only applies for periods spent as student or self-sufficient. It really needs no explicit mention! Obviously if the applicant has been employed for the entire duration of their stay prior to being settled they...

Sorry, this was meant to read 30 September 2020 - I instead typed the date from the web page, not the one from the document.

Re: General discussion on CSI and Settled Status. Big issues for people on the EEA-Applications Routes

Good character: nationality policy guidance (2 October 2020), section "Immigration related issues". People who are entitled to reside in the UK under the EEA Regulations 2016 do not require leave to enter or remain. In assessing whether a person has complied with immigration requirements over the p...

Re: General discussion on CSI and Settled Status. Big issues for people on the EEA-Applications Routes

The good character is 10 years regardless, It has always been there This is true. Not "always" but for a considerable while. And so were the rules around breaches of immigration laws under which, in theory, not having had CSI when required should always have been considered as a breach. So this is ...

Re: General discussion on CSI and Settled Status. Big issues for people on the EEA-Applications Routes

In my opinion 'caught by this' is for non-EEA people who can overstay and have an expired visa. For EEA citizens is proving 5 years lawful residence in any period of the 10 years. Since 15 of May 2020 the form is asking you to attach CSI for periods of financial inactivity in the 5 years back to th...

Re: General discussion on CSI and Settled Status. Big issues for people on the EEA-Applications Routes

The May 15 update was applying to applications made after that date What official (i.e. from HO) evidence have you got of this? The reports on this forum of successful applications (those that may have been affected) since then, while encouraging, are only anecdotal evidence at best as it is not po...

Re: General discussion on CSI and Settled Status. Big issues for people on the EEA-Applications Routes

hello, is this new 10 years CSI update of the 30th September also affecting who applied before the 30/09/2020?!!!!! Unfortunately there is no way of knowing for sure how this rule will be applied until we start to see reports of refused applications on those grounds. As @alterhase58 mentioned we ha...

Re: General discussion on CSI and Settled Status. Big issues for people on the EEA-Applications Routes

1- As the Permanent Residency can be backdated, can I apply for it, now that I have been granted Settled Status? You can. However, PR status is based on EU/EEA regulations and you only become eligible for PR status after being resident in the UK for 5 years under these regulations. Which means 5 ye...

Re: 10 years employment history British citizenship application

I don't remember my one job(part time) which I did worked 9 years ago Why don't you check against your HMRC tax record? Any tax that you have paid from employment should be on your record and will include employer details. You can [register for and] log into your personal tax account online. Maybe ...

Re: General discussion on CSI and Settled Status. Big issues for people on the EEA-Applications Routes

Hi guys, Please, correct me, if I am wrong in the following scenario: • An EU citizen is applying for BC in 12 months after obtaining Settled Status. • HO will check 4 years (before getting Settled Status ) + 1 year after. • In some circumstances the candidate must have CSI, but only for the first ...

Re: General discussion on CSI and Settled Status. Big issues for people on the EEA-Applications Routes

I understand you might not have good experiences with them. But like I mentioned before they were correctly updated in the topic. I didn’t have the feeling to talk to incompetent staff. Also the point is as we can see CSI isn’t considered so far as we have seen here and I have on other places and i...

Re: General discussion on CSI and Settled Status. Big issues for people on the EEA-Applications Routes

[Perhaps the moderators might wish to aggregate such reports into a separate topic re outcomes for EU Settlement Scheme people without CSI for certain periods] We do NOT need yet another unnecessary duplicate topic that becomes difficult to moderate. Fair enough. It was a suggestion purely based on...

Re: General discussion on CSI and Settled Status. Big issues for people on the EEA-Applications Routes

I'm very happy to see a trend emerging and congratulations to all who got their citizenship! If I may ask, could people who got approved despite not having CSI for certain periods please share - if they so wish - a short timeline of the circumstances surrounding their application? I believe this wou...

Re: General discussion on CSI and Settled Status. Big issues for people on the EEA-Applications Routes

I’ve called HO they said the new requirement is from the time the guidance is in place (14th May I think it’s been published). I called after a friend contacted them last week and received the same information. I called the home office today as well and they said the samething :) *fingers crossed* ...

Re: General discussion on CSI and Settled Status. Big issues for people on the EEA-Applications Routes

The requirement for settled status was 5 years in the UK, do you think that lack of CSI could lead to troubles with settled status in the future, for those, that already have it, but didn't pay CSI? No. Settled status itself does not require CSI and cannot be invalidated due to lack of CSI. Clarifi...

Re: General discussion on CSI and Settled Status. Big issues for people on the EEA-Applications Routes

@Stefan Piatek, The circumstances you quote are very different. I am not sure, why they would ask those additional documents? A baby born to a person settled in the UK will be British automatically. However, this still requires proof that one or both of the parents had already settled at the time of...

Re: Does the CSI requirements apply to people who already have PR

I am the partner of an European citizen, I have been in the UK for the last 10 years and since 2015 I have a permanent residence card. I was wondering whether the new CSI requirement will affect me when I apply for British citizenship? No. The new rules do not affect those with DCPR. This is becaus...

Re: General discussion on CSI and Settled Status. Big issues for people on the EEA-Applications Routes

So I understand 'prior to Settled Status' means in the 5 years time of the qualifying period for British Citizenship which I understand is from the date of British Citizenship application backwards, is it not? If you're referring to page 26 of the new guidance which instructs the caseworker to " as...

Re: General discussion on CSI and Settled Status. Big issues for people on the EEA-Applications Routes

As I understand it, it is about the last 10 year history and there shouldn’t be times without CSI in case of being economically inactive, not about 5 years. Look at the quote above they asked here now to prove CSI for 2013 which is 7 years ago. This is the main thing from that article that caught m...

Re: General discussion on CSI and Settled Status. Big issues for people on the EEA-Applications Routes

It doesn’t apply to applicants with pending applications. I got approved this week for BC and been in the UK prior to settled status as a student without CSI. Congratulations! That's great to hear. However, I would be wary of whether this actually means that it doesn't apply to pending applications...

Re: General discussion on CSI and Settled Status. Big issues for people on the EEA-Applications Routes

For example, withholding relevant information or using deception in immigration applications over the last 10y period will lead to refusal. It goes back longer than that. "the deception is regarded as continuing until the date on which it is discovered or admitted. For example, if a person used dec...

Re: General discussion on CSI and Settled Status. Big issues for people on the EEA-Applications Routes

I was actually caught out by this myself. I had CSI during my time as a student here but lost my EHICs, and my home country only issues E104s as proof of past coverage. When I applied for PR, I included my E104 together with the practice note recommended by the website you linked to. The Home Offic...

Re: General discussion on CSI and Settled Status. Big issues for people on the EEA-Applications Routes

The more pressure people put on MPs the sooner we will see this debated (I hope). Just FYI, but the government controls the time and schedule of the House of Commons. MPs can question the government on specific policies through Select Committees, but the opportunities for backbench and Opposition M...

Re: General discussion on CSI and Settled Status. Big issues for people on the EEA-Applications Routes

Do you have the same N by any chance?? From your experience with this document, having covered the period I need for CSI on Point 7, Is enough?? Thanks a lot!! I'm afraid I can't confirm this because back then I didn't use S041 / E104 or any of the standardised forms. As I mentioned my case was qui...
