Such a child can only settle when your partner does. They also do not have any automatic entitlement to British citizenship.

You do not need 5 years. You can be granted ILR within 28 days of completing your 5 years.

Also you may apply early and benefit from the date of decision for ILR: Applicants can benefit from the date of the ILR decision

You cannot have a gap of unlawful residence. You need to start the 5 years from scratch assuming the first FLR was rejected as invalid. Why was that FLR rejected as invalid rather than refused ?
