Re: Adequate maintenance: Calculating after April 2014

Yes, I'm just asking if it's alright that the savings very recently came from a retirement account.

Re: Adequate maintenance: Calculating after April 2014

Amber, I'm wanting to use funds in a retirement (IRA) account as the US applicant for a UK fiance visa, to show adequate maintenance for myself. I've planned to move funds from my IRA (paying a penalty for early withdrawal while doing so) into my ordinary bank account, so that the funds will be read...

Re: Arrests vs. Convictions

Amber, you have been very knowledgeable and very helpful in many threads on this forum. I don't want to be cheeky, but might I enquire as to your background? Are you a solicitor, or perhaps are you familiar with the law as a matter of having to deal with it in your own personal affairs? Thank you ag...

Arrests vs. Convictions

Hello- I have two arrests on record in the United States, however, all charges were dismissed in both cases. This means that technically, I do not have any criminal convictions in the United States (or anywhere else). Can I safely answer "NO" to the question of criminal convictions on my application...

Re: Two Common Marriage License Questions

Casa, are you saying you can marry on a visitor's visa? I know for sure that's not allowed, or in the very least, would very likely be viewed as deceptive. I'm asking if we can sign the license in preparation for the wedding while I am there as a visitor. I would then leave, apply for the fiance vis...

Two Common Marriage License Questions

In regards to common marriage licenses: 1. Is it acceptable for a couple to apply for a common license when one of the pair are in the UK on a visitor visa, or must they first have a fiance visa before applying? A person at the diocesan registry has told us that it's fine to apply on a visitor visa....

Re: Adequate maintenance: Calculating after April 2014

Amber- In addition, I seem to be getting different opinions from different solicitors regarding the standard of proof for adequate maintenance. Some say it is as simple as following the formula--either the numbers work out, or they don't. Others say that in addition to this, spending habits will als...

An immigration plan. Will it be likely to work?

Hello- I am a US citizen and wish to immigrate to the UK under a fiance visa, to marry my partner, who is a citizen of the UK. My plan assumes two things: 1. My partner is exempt from the minimum income requirement if she receives any level of DLA benefits. 2. I can provide the income required for "...

Visit UK as a visitor while awaiting decision on settlement

This might seem crazy, but I would like to know if the following would be possible: 1. I submit an application for a settlement (fiance) visa, handing over my US Passport to the UKBA in the process. 2. I request a replacement US passport from the authorities here, to use while my primary passport is...

Re: Fiance visa priority application.

I'm applying from the United States. I don't have any prior problems with obtaining visas, being deported, etc.

Thank you.

Fiance visa priority application.

Hello- I wish to submit a fiance visa application around October the 20th. I am aware that criminal history can affect priority applications. In my case, I have a couple of charges (not actual convictions) from 2004 and 1999. The maximum punishment for the charge in 2004 would have been a $500 fine,...

Re: Adequate maintenance: Calculating after April 2014

Can anyone comment on exactly where the [savings] / 104 formula comes from? As in, where it appears in some official documentation?

Also, for those of us only required to make adequate maintenance, how long must the money have been in our savings or checking account?

Complicated timeline problem.

I am a citizen of the United States, and am a university student, set to graduate with a 4-year degree this December. I wish to apply for a fiance visa to marry my partner, who is a British citizen. She is disabled, and we plan to apply using her DLA benefits to exempt her from the annual income req...
