Re: Travel with Residence Card - Success Stories

Thought I'd share what is our first and probably last experience using the Mrs EU residence card issued under the Surrinder Singh judgment to enter a schengen country. We booked a trip to Algarve in Portugal via Ryan Air from East Midlands Airport (EMA). When arriving at EMA my wife had to get a vis...

Re: UK to end freedom of movement for EU citizens on day one of Brexit

EU law still applies to the UK until Brexit day and there should be no problem as long as the return is before 31st October. I hope this will be the case as we have a planned holiday to Portugal at the end of September and Mrs is relying on her EU residence card for entry.

Re: Does the UK not abide by the Eind Ruling

The paragraph I quoted above from the unreported case counters the Home Office argument in O & B that BC must exercise treaty rights on return because the Directive applies by analogy. In this judgment the judge came to the conclusion through O & B that this in not the case as opposed to Eind. Both ...

Re: Does the UK not abide by the Eind Ruling

In this very recent unreported case the UTT judge after analysing the case of O & B came to the conclusion there was no need for BC to be engaged in qualified activities when they return home. 13. Following O and B, the UK national exercising Treaty rights in another Member state before returning ho...

It may also be worth contacting your MP to see if they can get to the bottom of the reason for the delay.

Re: Surinder Singh Settled Status Paper Application:

Re: Surinder Singh Settled Status Paper Application:

The front of the form does state to complete the sections of the form that applies to you. It may be the case that only those people will be asked to provide centre of life info who have not previously been issued a residence card. Since the centre of life requirement is not lawful in EU, they may r...

Re: Surinder Singh before dec 2013

I think the main change is the Settlement Scheme is that the British citizen does not need to provide evidence of exercising treaty rights such working studying etc There was never a requirement to be a qualified person on return to the UK in EU law. It was invented as another means to refuse appli...

Re: Surinder Singh Settled Status Paper Application:

With the Brexit date being put back again its looking unlikely by the day the UK will leave the EU. The Home Office probably acknowledge this and are looking to wrap up the scheme soon hence not bothering with Surinder Singh applications. Just a thought.

Re: UK removes words 'European Union' from British passports

I have a passport issued in February 2017 and it does not state I have the right to consular assistance from the consulate of any EU Member State.

They may have removed it shortly after the 2016 EU referendum.

Surinder Singh route extended to March 2022 for returning Brits after Brexit

Britons living in the EU who return to the UK after Brexit will be able to bring non-British family members until the end of March 2022. The date has been announced in a UK policy paper on citizens' rights in the event of a no-deal Brexit. UK nationals will also be allowed to bring in children who w...

Re: Has anyone tried the now fully opened application for EU settlement scheme?

Where a previous biometric residence card has been issued it makes no sense to require applicants to make a paper application especially if they are not going to require evidence of residence in another EEA state. I don't think they have fully thought it through and may make changes to their policy....

Re: Brexit Cancelled, What next for Settled (ILR) and Pre-Settled Status

It will depend very much on the form of brexit we have. If we get a soft Brexit where UK retains access to the single market then free movement continues and applications will have to assessed on the basis of exercising a treaty rights as opposed to just residence under the EU settlement scheme. Nor...
