Yes, you become an overstayer. Yes you must submit an application within 14 days of AR refusal. Thank you for your reply CR001. in that case, i submit a t2 application in 14 days, do i have to be granted within 14 days or i can wait for the application decision as i found that 3c or 3d doesn't ...

There is a different for ILR applications based on different routes: Tier 2/work permit: application must have been made within 28 days blah blah... 10 year long residence: Cannot have been out of the UK for more than 6 months at a stretch and it doesn't matter if a new application wasn't made ...
