Re: How treaty rights period is counted?

Thank you for replies.

I think I've read that the onus is on a person to prove that they were in a country at a certain day when they apply for PR. Is this true for PR applications or only for ILR? Is there a way to prove that if you don't have a plane ticket (only in pdf format)?

Claiming if not worked in a home EU country?

If a person did not work in their home EU country, would they have a right to claim JSA and other benefits in 3 months after arrival to UK?

Re: EU national. How to settle in UK despite possible EU exi

Then, suppose the British people will be so stupid to prove me wrong, there will be a period of at least two years before the step of leaving the EU will actually take place (see the Lisbon Treaty for that). So we're talking about 2019 as about the earliest possible date for a Brexit. If 2019 the ...

Re: EU national. How to settle in UK despite possible EU exi

The whole point of the idea is to prove the legality of your presence in the UK ON THE DATE OF BREXIT. The UK immigration policy always comes with a transitional arrangement every time it undergoes a change. This is probably the key thing which I did not understand fully. At first I thought that ...

Re: EU national. How to settle in UK despite possible EU exi

Whilst I found the contribution of Yoshi very interesting and informative, I think I have been compelled to contribute to this thread, albeit in my view it's a bit like exacerbating the consequences of Brexit, and contrary to what many may like to think, freedom of movement is not a result of ...

Re: EU national. How to settle in UK despite possible EU exi

Now, can you still believe that you and your likes will be shipped away en masse post-Brexit? Do you think Spain and France can afford sending back every British national back to Britain as well? I was desperately trying to find this out in this thread but the only person who actually cared to talk ...

Re: How to settle in without anything before arrival?

You can ignore my question about minorities. What I was asking for is something like this http://www.theguardian.com/news/datablog/interactive/2011/may/19/ethnic-breakdown-england-wales to decide where I could fit in better. Also, my questions about rent options are probably unrealistic really (it's ...

Re: EU national. How to settle in UK despite possible EU exi

From what I've read about those HSMP holders, if I remember right, they've had work permits when 4 years have passed. I think many EU nationals after exit will not be eligible for work permits if that's going to be required. I think it's because their visa ended or something. Not sure. I've read ...

Re: EU national. How to settle in UK despite possible EU exi

Now, think about the UK government trying to retrospectively alter the rules and apply them to literally millions of people legally living here up till the future Brexit. They recently tried to do something similar to those HSMP holders by changing the residential qualifying period towards ILR from ...

How to settle in without anything before arrival?

So far I don't know which city I would need to go to. I lived in London so I know it a bit, I have payed 320 pm for a room with a bed which is enough for me. Is this still realistic a price or is it more expensive now? If possible, I would like to have it cheaper. How long will it take to get all ...

Re: EU national. How to settle in UK despite possible EU exi

No contradictions there. One is regarding applications done before any changes, i.e. applications done using the current EU framework, which would not be valid anymore for new applications if the UK exits the EU. If "fine" means being able to stay in UK indefinitely and you said that those who ...

How treaty rights period is counted?

Just want to make sure. Is treaty rights period (5 years for the purpuses of PR) counted from the day a person enters UK or from the day a person applies for EEA1 or starts working/being jobseeker/self-sufficient?

Thank you.

Re: EU national. How to settle in UK despite possible EU exi

If anyone has the same situation that I do I assume they will post here and tell me about it. So far nobody else seems to care. If I'm just going to post here what I have I will be talking to myself. I have some info, none of it 100% sure obviously and none of it makes me certain. Even the article ...

Re: EU national. How to settle in UK despite possible EU exi

There's no amount of questioning that will help you with it. As I've said, there is no framework or guarantees in law regarding the immigration status of EU citizens in the case of UK exit of the EU. There simply isn't any, this situation is not covered by law at the moment and is completely ...

Re: EU national. How to settle in UK despite possible EU exi

I very much appreciate all the help and answers I've received. ban.s likely knows way more than me about UK politics and if he said that referendum is unlikely, that opinion likely has good weight. I wish I could just stop there. Man, seriously, stop going mad over something that is out of your ...

Re: EU national. How to settle in UK despite possible EU exi

Some of the assumptions made by these MPs regarding EU state citizens' statuses in case of UK exit of the EU are based on human rights enshrined by law in the UK Can you specify what rights would those be? I have read this list http://www.equalityhumanrights.com/your-rights/human-rights/what-are ...

Re: EU national. How to settle in UK despite possible EU exi

To speak with certainty means nothing if such certainty isn't based on the rule of law. I agree. Which is why I am not just listening to what MPs say but I'm trying to make sure that they're basing it on the law. That MP also said after he said that think I quoted that it would not be possible ...

Re: EU national. How to settle in UK despite possible EU exi

You won't find any laws about this subject, simply due to the fact that they don't exist. There is no legal framework regarding EU-state citizens statuses if the UK drops out of the EU. But some people clearly speak about it with certainty, see quotes above. One person said that everyone who made ...

Re: EU national. How to settle in UK despite possible EU exi

In addition to what I wrote above I have found another quote which states: If you have already been working/studying (or otherwise exercising treaty rights with the proper medical insurance if required) you would already be eligible for PR in the UK. That way, leaving the EU wouldn't have an impact ...

Re: Overstayed in the past, does it mean it's over?

An EU national can never become/called as an overstayed even for not exercising its treaty rights. An EU national can leave/enter UK anytime. Thank you sheraz7! I want to make sure that I'm reading this correctly. Only non-EU nationals who require visas can be called overstayed, but if EU national ...

Re: EU national. How to settle in UK despite possible EU exi

Can I ask moderator to move this thread to "EEA-route Applications" section? Because almost every reply about it that I have found about Brexit was in that section. And my route seems to be EEA clearly if it's the same as EU.

Re: EU national. How to settle in UK despite possible EU exi

Well if you stop exercising your treaty rights, yes, that means you are not exercising them anymore... As for the other questions, I don't think anyone can answer them for sure...all we can do is speculate at this point, so the best thing to do is probably to wait and see what happens. Thanks a lot ...
