just wondering did you finally submit applicant passport with application or they accepted ID card ? did caseworker asked you to submit passport ?

also when did you booked appointment only , did they asked for passport details ?

HI, you need to visit INIS Main Office in Dublin and meet with GNIB Supervisor, also involve Solvit , otherwise your local Garda will drag it, also involve your local TD, Whats your local Gardri Name? its quite illegal to refused to implement INIS decision. Ireland ( Garda ) treat like Police state....

you cannot register with any other Garda unless you got permission from INIS, you might be from Kildare,

lady at Kildare Garda is __________.

if you are in Kildare, just move from there.

She is there from last 18 years and no one can challenge her. She is Godfather of Kildare .

I think Child Application will not affect because of mother visa status.

One of my Sibling have same case like yours. He applied for child registration while his ex-wife was illegal in country.

However Casa & other respected members will provide better advice.

Very Strange

Normally there is no Border/immigration Control...

i think too many people moved to Ireland from UK thats why they are checkig now.

i was stopped by UKBA at belfast Airport Twice.

i told them i am UK National, however they still confirmed from department... :) then let me go.

if your child born in the UK, you can apply for child registration as British Citizen.

It wont make any difference if your wife has no Legal Status.

You can relay on Surinder Singh Route, you need to provide maximum evidence that you and your partner lived and work or study in Italy and now coming back to UK.

Even partner visit visa expire wont make any difference.

you have three options.

Chase Department, involve Local TD etc

File Judicial Review against unnecessary delay.

Move to any other country with EU Partner or register your marriage and become Direct Family Member instead extended family member.

I think you can file appeal, i know you dont have right of appeal however you can still file an appeal and mention about new case ( Court of Appeal) and they will hold appeal until and full judgement will handover.

JR process is quite long in Ireland but its worth to try bec the objection is baseless and decision can be quash by High court.
but you have to wait 1 year for full hearing
