Re: ILR granted, waiting for BRP

1. The letter I received does not mention anywhere that ILR application has been granted. It just says that you will be issued a new card. But there are two other docs which mention that ILR has been approved even though it has no mention of my name or date. Is that the standard pattern for ILR gra...

Re: Past-Deception-effect on ILR

It appears that both the FTT judge and UT judge concluded that there wasn't any credible evidence of deception and both overturned HO's refusal based on deception. You should simply say "no" to the question that asks if you have ever used deception in any of your previous application but also provid...

In short, yes they can. Regardless of whether its a fresh application or AR, If there are other grounds of refusal, they could refuse you again.

Re: ILR refused under 245CD urgent

Also if they had any concerns about the genuineness of your income, they should have contacted your clients and asked whether the business was genuine or not which they clearly didn't. I myself have developed many websites and some of those companies I developed for have now collapsed and their webs...

Re: ILR refused under 245CD urgent

Admin review is only in place to point out any caseworking error that may have resulted in your application being refused. Caseworking error is not considering all the documents or wrong interpretation of the immigration rules. As soon as you provide more documents as part of the Admin Review your ...

Re: ILR refused under 245CD urgent

If you have this then this counts as the third (additional) evidence along with accountants letter and bank statements. It may arguably be a good practice to provide additional documents as "third" evidence but from legal point of view, if you just provide the required documents as specified in the...

Re: ILR refused under 245CD urgent

Is it still your responsibility to maintain those websites ? The refusal sounds extremely ridiculous to me. I am a software and web developer and I completely fail to understand what HO are trying to prove through nonfunctional websites. As a software/web developer, your duty is to develop a website...

Re: Delayed Self Assessment for ILR

Thanks guys for your reply. Just to clarify more, I am not doing any amended SA or resubmitting it because of change in fugures. This is the first time I did it for 2012-2013 & 2013-2014 now because my acountant didn't advise that time (my mistake too that I am not aware about it). Although I paid ...

Re: Delayed Self Assessment for ILR

I come to know that SA302 is mandatory for self employed. Not really sure who told you that but as far as the policy guidance is concerned, SA302 for previous years is not a mandatory thing. However, the caseworker may ask you to submit them. I was self employed during Dec 2012 - May 2013, then I p...

True but they will only take a decision after the fees have been paid and cleared (if through cheque) and the biometric data has been submitted.

Re: Few days Shortage for 10yr ILR thru Tier4 route

This is just what I recently read on this forum and is not an advice of any sort at all: I recently read a post on this forum regarding a similar case. The OP in that case was also short of a few months to complete his 10 years. He applied regardless, made a payment through cheque (perhaps to delay ...

Re: ILR and AR refused - Misunderstood the income

the rules says you MUST need to submit annual tax return for the period when you are/were a company director. Yours is one of those unfortunate cases that became the victim of different understanding of rules between HMRC and Accountants. A lot of accountants believe that you do not need to file a ...

Re: IELTS and Life in the UK Certificates LOST

HO may be able to retrieve LITUK test result. Some proof of having done test (where/when) probably required to do this. SELT is only £150 - save yourself the stress and get it done. Well LITUK is even cheaper. Why not get LITUK done as well and mention that you have lost both so you have retaken ? ...

Re: time between Naturalisation and Passport application

Regarding CR001's comments that there's no quick way to get a passport, I don't think this information is accurate. One of my friend had to travel a couple of days after he received his citizenship certificate because of a family emergency. He was asked to provide the medical proof and attend in pe...

My wife recently applied for her first passport and received it within 3 weeks. I personally know many people who all received their passports within 3 to 6 weeks. Not really sure why you think it will take ages. Your friend's case is probably either an exception or he confused his passport applicat...

Thank you longhorn, Yes it's for tier 1 general and I have now anyway gone and submitted an amendment to Hmrc now that I have done it should I wait for a response or go with a covering letter? Re: Tax return for the Director of company?

Hi Folks! Hi folks I'm applying for my ILR(LR) 10 years and just want to clear this ambiguity before I apply . I set up my company in Sep 2013 as a director. Applied for T1(E) 50k route. got refusal, appealed and finally got my visa in Feb 2015. I started taking director salary from April 2015. My ...

Re: ILR question due to tax return issue for unclaimed year

I dont really understand your problem and not really sure why you sound so worried ? By tier 1, I am assuming you are talking about Tier 1 General ? For the year in question when your self-employment income was zero, if you didn't show this year's income to HO for any of your previous applications t...

Re: URGENT!! IHS fee for ILR dependent application

Did you apply on Set (M) or set (o)?? I think the issue is that you have applied for ILR in the wrong category. Indeed. From the OP's dependants' timeline, it appears that they do qualify for the 2 year route to settlement. However as CR001 suggested, Its highly likely that OP has applied in the wr...

1. You have got ILR via Tier 1 General route ? You have not answered the most important question. Did you get your ILR through Tier 1 General route or through ILR (Long Residency) ? If it was long residency, your partner's clock for the time spent with you as your partner would have been reset to 0...

Try again and if still not available, try a different location.

I booked it for one of my family member recently and the system didn't show any appointment at the desired PEO. However, when I tried it again the next day evening, an appointment for almost everyday was available. Strange :)

Re: PEO ILR approval date V/S Date on BRP

For all my previous application at PEO including ILR, my date of issue on BRP was always the date of my PEO appointment. However, its worth noting that all my applications were always approved on the same day. If your ILR doesn't get approved on the same day, e.g. held for further checks et cetera, ...

If you resign from a job and have not still used your annual leave/holidays, they would either pay you a lump-sum or would keep you on paid holidays until they are all used. It depends on your employer's policy. If they kept you on payroll to pay for your due annual leave, this shouldn't cause a lot...

Re: National Insurance Contributions and Part time work

I don't think there is any NI threshold for naturalisation, only for ILR. Correct me if I am wrong ? There's no NI threshold for ILR as well. Its income threshold not NI threshold you are talking about. NI threshold is not really directly relevant to visas/citizenship. NI threshold is your income l...
