I came to the UK with my partner in July 2006, but was approved for HSMP in May 2006 (post April, but before...

UK ILR Timing and Redundancy

Hi guys: I have a bit of a unique situation.. and a few questions.. First, some background - I've been in the UK about 4 1/2 years, and I qualify for ILR on 3 July 2011.. Because I didn't come right away to the UK, my Tier 1 (formerly HSMP) visa expires 21 May 2011. I will also have travelled about ...

Depending upon where you're coming from, it is critical to register with the local police within 7 days of arrival. That info should be stamped on your visa if it is a requirement. You can apply for an NHS card, but you must show that you are actively looking for work. This means that you will need ...

I'm confused by your current status. I'm going to attempt to answer anyway, with a couple of scenarios depending upon your status. If you are currently on HSMP, then your visa is not a dependent visa. If you are renewing your HSMP as Tier 1, and you wish your wife to be a dependent, then I would app...

Everybody knows that these steps are quite separate and c...

I know we don't have the details yet, but I'd be surprised if it affects renewals. The impact to employers would be great in that they'd lose people because they couldn't renew. Add to that, the tightening up of the Tier 2 visas, which would make it harder for companies to change someone from Tier 1...

Technically, you would be considered resident in the UK once you come here with the intention of living permanently. The issue then is that you would be subject to UK tax on your income, especially since you would be working in the UK. I think the difference between what is being talked about (someo...

This will affect Tier 1, as well.. At least based upon my interpretation of the Times article.. Yes, it is good news for those that can't prove that they're subject to harm if returned to their country. But it's also not so good.... The UK law changes have all used phony asylum seekers as a reason why they need to toughen up on all areas of immigration, and there is a backlash against asylum s...

This should be moved to the US immigration section..

You should apply for a fiance visa for the marriage, and then you can convert it to a residence permit for the US.. That would allow you to work without sponsorship.

At this point, I think they need to submit a new application. Appealing only helps if there was a problem in the decision process, and you're limited in being able to provide additional documents. Since some key information was left out, starting over with a complete and correct application is the b...

I agree, your employer probably isn't aware of the specifics, but the reality is that you already have the right to work in the UK through your Tier 1. I wouldn't switch to Tier 2, since it will tie you to this employer.

1) I have read somewhere that there is a 90 days clause, wherein the Tier 1 Applicant cannot be outisde UK for more than 90 Days at one go or else it may delay ILR and reset the clock. Is that true? because I plan to go to UK alone on April before the 90 days expire. Yes, time that is excessive outs...

I know they've been saying in the papers that it's for those newly arriving, but I can't fi...

You could run into serious problems since they've now overstayed. I would not send them back to India. They could technically now be banned from re-entering the UK for 1 year. Your assumption is correct, if they were work permit dependents, then they needed to have their visa changed at the same tim...
